在理想与现实之间:地方立法中的公众参与

就理想层面而言,公众参与地方立法是直接民主的体现,有利于弥补代议制民主的不足,提升地方立法的民主性和科学性,促进地方立法预期目标的实现.然而,在当前社会公众参与地方立法实践中,公众参与的主体资格、事项和过程均受到一定程度的限制,导致公众参与的范围较窄,公众参与的意愿较低、程序不够规范、组织化程度不高,公众参与的实效性不显著.因此,我们需要重新审视一些地方关于公众参与地方立法的规定,进一步完善地方立法中的公众参与制度,拓展公众参与的普遍性,提升公众参与的实效性.

Between ideal and reality:Public participation in local legislation

As far as the ideal level is concerned,public participation in local legislation is the embodiment of direct democracy,which helps to compensate for the inadequacy of representative democracy and promotes the democracy and scientific nature of local legislation.However,in the current practice of public participation in local legislation,the subject qualification,subjects and process of public participation are limited to some extent,which results in a narrow range of public participation in local legislation.The willingness of public participation and the degree of organization are low,and the procedure is not standard,which leads to the effectiveness of public participation is not significant.Therefore,we need to re-examine some local regulations on public participation in local legislation,and further improve the public participation system in local legislation,to expand the universality of public participation and enhance the effectiveness of public participation.
