社会治理视野下电信诈骗防范协同机制研究

互联网技术的飞速发展与传统社会秩序的缓慢变迁为电信诈骗的滋生壮大提供了肥沃的土壤,电信诈骗已经成为现代社会治理中的毒瘤.目前,防范电信诈骗的立法体系有待完善,行政监管不到位,侦查机关技术手段相对落后,特别是各部门之间协同机制效果不足.应当以社会治理理论为指引,强化技术与法律的双重保障作用,并通过建立由个人、电信和金融企业、行政机关及司法机关、社会组织、媒体五方组成的电信诈骗防范协同机制,以期实现对电信诈骗犯罪的有效预防和有力打击.

Synergistic mechanism of telecommunication fraud prevention from the perspective of social governance

The rapid development of Internet technology and the slow change of traditional social order provide a breeding ground for telecom fraud.For the regulation of telecom fraud,the legal system still need to be optimized.Administrative supervision is widely overlooked and the technical means of police are lagged behind for a long time,especially the absence of synergy mechanism between different sectors.Based on the operation mode of telecom fraud and the public's cognition,combining with the social governance theory, telecom fraud prevention synergy mechanism should consist of five subjects,containing individuals,telecom and finance companies,government and judicial branches,social organization and media,with the double backing of technology and law,to achieve the reasonable prevention and efficient regulation of telecom fraud.
