农村集体经济组织的现实困境和法律构造研究

在经历了经济社会的体制机制变迁之后,农村集体经济组织呈现出多元化的法律形态.农村集体经济组织包含集体所有、自主经营、独立核算和民主管理的法律性质.但是,农村集体经济组织的制约性因素正成为农村集体产权制度改革的现实阻碍,如农村集体经济组织的法人登记、成员资格认证、经营管理以及集体产权处置的问题尚待完善.因此,从法律制度顶层设计上完善农村集体经济组织已是现实需求,有必要制定《农村集体经济组织法》专门规定与农村集体经济组织制度相关的法律性质、法律原则、法人类型、资格认定、经营管理以及产权处置等法律问题.

Study on the realistic difficulties and legal structure of rural collective economic organizations

Through the change of the economic and the society,rural collective economic organizations have grown into multiple legal forms.Rural collective economic organizations have the legal attributes of collective property,collective operation,independent accounting and democratic management.However,the realistic difficulties have become the obstructive factors of the reform of rural collective property,such as the problems of registration of juristic persons,the qualification authentication of the members,the operation and the disposition of the collective property.Therefore,it is necessary to establish the legal system of rural collective property from the top design.And then,the Act ofRural Collective Economic Organization should stipulate the relative legal problems,such as the legal attributes,the basic principles,the qualifications of the members,the operation and the disposition of property.
