当代中国的法治社会化:缺失与建构

中国的法治社会化,在主体、客体、内容等方面存在着诸多弊端,原因在于中国缺乏法治社会化的自然的途径和精神力量,中国传统法治观的影响,使法治社会化的推动主体的动力不足,甚至成为法治社会化的障碍。法治社会化的渠道中也存在诸多缺陷,不利于法治人格培养和法治信仰形成。同时,法治产品的严重短缺,使人们丧失了法治社会化参与的积极性。我们应发展市场经济为法治社会化创造经济条件,发展市民社会为法治社会化奠定社会基础,塑造中产阶层加大对重点人员的法治社会化工作,培养合格的法治社会化客体。

The Socializing of Rule of Law of China:Its Defects and Construction

The socializing of rule of law of China has many defects in its leader subject, objects and contends. The reasons are as follows: Firstly, the socializing of rule of law of China has not naturally ways and spirit power as the Christianity in the socializing of rule of law of west world. Secondly, because of the affection of traditional understanding about rule of law, the leader subject not only has not motive power to force the socializing of rule of law of China, but become obstruction of the socializing of rule of law as well. Thirdly, there are many defects in the ways of the socializing of rule of law of China, which hinder people's believing in law. Fourthly, because of the seriously shortage of products from rule of law, people has not zeal to take part in the socializing of rule of law. So we should develop market economy, construct civil society, promote the development of middle class, and strengthen law education to some special people.
