| 摘 要： | 在精神损害赔偿制度中,赔偿范围的确定历来是法学理论界关注的焦点问题,也是立法过程中的难点问题。在今后的立法中,应当规定对法人所受的精神损害予以赔偿,并逐渐完善有关人格权方面的精神损害赔偿制度。

| Abstract: | In the institution of compensation for mental injury, how to confirm the range of compensation was a focal point which has been discussed by jurists for a long period of time and which is a difficult problem in the process of legislation as well.In legislation for the future,the legal person should be compensated for mental injury,and the institution of compensation for mental injury concerning right of personality also should be gradually improved. |
