| 摘 要： | 证据的预防规则是指为防止某些证据自身存在虚伪或错误的特殊危险,而设置相应程序加以事先防范的规则。本文探讨了预防证据规则的理论基础,从比较法的角度对预防证据规则进行考察,分析我国现行法律证据预防规则的缺失,并提出建立预防证据规则的设想。
