| 摘 要： | 科技与法律都源自于并服务于人性,要实现人性科技的终极目标就需要对科技活动进行符合人性主旨的法律导引,从人性根基的维度探求法律对于科技的深层影响力。这主要表现为法律对人的科技创造力的开发及建设性指向导引,法律对人的科技创造活动自由的权利促进与维护,法律对人的科技创造成果的利益回馈以激励动力,法律推进保障人性科技基础上的创新型国家建设。
