| 摘 要： | 国际人道法的基本原则之一即为比例性原则.战时比例性原则的适用法律问题主要包括对附带损害和军事利益两大要素的考察,与战时比例性原则的适用标准相关的理论与实践,以及战时比例性原则与军事必要性原则的区别和联系.适用战时比例性原则的价值评判标尺是军事行为所造成的附带损害与预期整体军事利益相比是否明显过分,这将通过在战时比例性原则两大要素间进行拟制比较的途径得以实现.

| Abstract: | The principle of proportionality is one of fundamental principles of international humanitarian law. The legal issues of application of the principle of proportionality in bello mainly consider the two elements about the incidental loss and military advantage, the related theories and practices about the standards of applying the principle of proportionality in bello, and the difference and connection between the principle of proportionality and the principle of military necessity. The value dimensions for judging the principle of proportionality in bello lie in whether the incidental loss seems to be clearly excessive or not when it is compared with the whole anticipated military interest. This will be carried out by the comparison between the two elements of the principle of proportionality in bello. |
