小产权房面临的法律困境及其出路探讨

小产权房一直是社会关注的热点问题。虽然从目前来看是不合法的,但是小产权房却依然购销两旺。就其根源主要是土地相关法律制度在立法、执法和司法上都存在一系列的法律困境,以此在对小产权房面临的法律困境分析的基础上,提出了小产权房合法化的途径,其中关键是要建立城乡统一的土地制度以及防止政府公权力的异化。
