城市化背景下中国土地承包经营权流转制度研究

中国城市化进程中伴随着大量的农村劳动力向城市流动,加之家庭农业小规模效益低下,导致我国农地利用率存在严重问题。加强土地承包经营权的流转是解决该问题的重要途径。这要求国家明确土地承包经营权的流转方式,确认土地能够通过转让、租赁、互换、入股、抵押、投资等方式流转。其中转让、出资和抵押无需经过发包方的同意。通过税收政策引导资金和企业流向农地流转市场,对农业经营者在所得税、流转税等税收政策上给予适当优惠。在此基础上培养扶植一个繁荣的农地流转市场。农地流转市场具体可分为自发零散市场、合作经营市场、龙头企业主导市场和金融机构参与市场。政府应当组织一个有形的集中市场以促进和规范农地的流转。
