中国农村土地承包经营权的产权残缺与重建研究

摘    要:现行农村土地承包经营权在明晰性、排他性、安全性、可转让性、权能责任利益对称性、可实行性等方面都存在一定的缺陷,而这又与其法律属性不明确有关,土地承包经营权是在特定历史条件下以债权形式出现的具有一定自物权属性的且呈现具有普遍意义的物权化变迁趋势的特殊的土地权利。本文首先根据产权经济学的基本理论提出一个分析农地承包经营权的一般框架并运用这一分析框架对现行农村土地承包经营权制度进行分析,然后探讨农地承包经营权的法律属性,在此基础上,提出相应的完善农村土地承包经营权制度的政策建议。

Abstract:There are some defects in the current rural land contract in terms of clarity, repellency, safty, transferability, symmetry of rights and interests, feasibility. And this has something to do with the inexplicity of its legal attribute. In light of the economics of property rights, this paper puts forward a general model of rural land contract, and applies this model to the analysis of the current management system of the rural land contract. Then the legal attribute is approached before the corresponding suggestion of complete policy is proposed.
