全球性时代的人权

本文认为,以西方文化为特色的人权正在获得全球性。这种全球性表现为:人权成为全人类的普遍关怀;人权规则在各国宪法和法律中得以普及,并逐步形成了一系列效力遍及全球的具有多样化的人权规则系统;联合国和各区域性国家组织形成有关人权保障的制度;人权问题已成为全球的核心问题之一。文章还就人权全球性获得的原因、人权的全球性与人权的民族性的关系、人权与国家主权的关系等重要问题从理论上作了阐述,提出了有价值的观点。

Human Rights in the Global Era

This paper proposes that the human rights featuring western cultur e are b ecoming globalized.Evidences show:human rights attrac t the solicitude of all human race.The regulations of human rights have been disseminated,so t hat a regulation system of human rights is being fo rmed.The United Nations and all the regional national organization have constituted the guaranteed reg ulat ions of human rights.Human righ ts have become the critical problem of g lobal politics.This paper puts forw ard some valuable points in terms of causes,and the relation between the globalization and nationalization of human rights.
