中美高校学生申诉制度的比较分析--以北京邮电大学和麻省理工学院为例

高校学生申诉制度是维护学生合法权益的救济制度。针对我国高校现行申诉制度的一些不足之处，从申诉委员会的组成、委员会的权利、学生违纪处理及申诉的一般程序、受理学生申诉的范围等几个方面，以北京邮电大学和麻省理工学院为例，对比研究了中美高校的学生申诉制度，并在此基础上提出完善我国高校学生申诉制度的建议：①淡化申诉委员会的行政色彩；②适当扩大申诉委员会的权利；③在处分结论得出前要充分发挥听证会的作用；④严格执行回避制度；⑤进一步扩大受理学生申诉的范围，确保学生的各种合法权益都能得到保护。

Comparative Analysis of Student Appeal System Between Chinese Universities and American Universities---Taking Beijing University of Posts and Telecommunications and Massachusetts Institute of Technology as Examples

The appeal system of the university is the means of relief to uphold the student ’ s legal rights.Focu-sing on the defects of the appeal system in China , comparative analysis of the appeal system is made between Beijing University of Posts and Telecommunications ( BUPT) and Massachusetts Institute of Technology ( MIT) in the aspects of the members of the Appeal Committee , the rights of the committee , the general procedure of handling appeals and the range of accepting appeals.Some suggestions on how to perfect the appeal system of the Chinese universities are put forward:①Weaken the administrative color of the Appeal Committee;②Properly strengthen the rights of the Appeal Committee;③Give full play to the hearing before coming to the conclusion of punishment;④Strictly implement the avoidance system;⑤Further extend the scope of students ’ appeal in or-der to protect their various legal rights.
