The legal protection of new/high-tech IP is a problem to solve in urgent need,which has been focused on for long by industrial interests,technological philosophy and law studies.Such a protection has some features which are quite different from that based on traditional IPL in not only the timeliness and locality of a technology but also its scope to protect and confidentiality.The technological and legal characteristics of the right of business secrecy for new/high technologies are discussed to elucidate that the new way and viewpoint are necessary to protect effectively the new/high-tech IP.The best legal selection should be such that the protection of the right of business secrecy must be the core with some other IPRs as auxiliaries in legislation.
