| 摘 要： | 法律思想的形成是离不开政治斗争和法律实践活动的。统治阶级运用法律这个工具来实现对社会和国家的统治和管理。明朝开国皇帝朱元璋在创立、巩固新政权的过程中 ,十分重视封建法制的建设与实践。并在长期的政治斗争和法律实践活动中 ,形成了自己具有针对性的法律思想。该思想成为明初立法和司法的指导思想。虽有偏颇之处 ,但对明初社会的稳定、经济的发展起到了积极的促进作用

| Abstract: | The form of legal thought is connected with political struggle and legal practice. The ruling class rules and manages the country by means of legal. During the process foundation and consolidation of new political power, Zhu Yuanzhang, the first emperor of the Ming Dynasty, paid special attention to the construction and practice of feudal legal. His legal thought formed in the long time political struggle and activities of legal practice. The thought became the guiding ideology in judicature and legislation in early Ming Dynasty. Though it was not so perfect, the thought promoted social stability and the development of economy. |
