论高校实施《中外合作办学条例》的意义与问题

颁布中外合作办学条例，对于规范、指导高等教育中外合作办学，促进教育教学改革，改革人才培养模式，加强国际理解，构建终身教育体系方面，有十分积极的意义。但还存在条例对国内高校到国外合作办学没有效力，对中外合作办学公益化界定不能反映中外合作办学实际，教育行政管理不适应中外合作办学事业发展等问题。

Great Significance and Issues on Applying Regulations of the People''''s Republic of China on Sino-Foreign Cooperation in Running Schools in Universities

The issuance of the Regulations on Establishment of Educational Institutions under Sino-foreign Cooperation has very positive impact on regulating and supervising sino-foreign cooperation in higher education, promoting educatinal reform, reforming existing models of talent education, enhancing international understanding and establishing the system of life-long education. But there are loopholes in the new regulations: they have no jurisdiction over domestic institutions establishing branches overseas, there is no realistic definition on the non-profit nature of sino-foreign cooperation, and the administration of higher education cannot satisfy the needs of the development of sino-foreign cooperation.
