法治视阈下新型农村合作医疗制度可持续发展探析

研究旨在坚持和完善新型农村合作医疗制度，保障新型农村合作医疗制度可持续发展。在理论分析与调查研究的基础上，认为制度的科学性与公平性、制度的效果、制度的保障，是影响新型农村合作医疗制度可持续发展的主要因素。当前新型农村合作医疗制度存在的主要问题是，筹资、补偿、自愿参与、医疗基金与医疗机构监管等。保障新型农村合作医疗制度可持续发展，应走法治之路，以法律之治代替政策之治。制定《新农合条例》，应坚持科学民主的立法理念、人权保障和权力制约的理念，坚持强制性、保险基金征用法定等社会保险法的基本原则，处理好医疗机构监管、农民工医疗保险、与医疗救助制度的衔接、与其他医疗保险制度的衔接四个突出问题。

Researches on the Sustainable Development of New Rural Cooperative Medical System from the Perspective of Rule of Law

The purpose of the study is to adhere to and perfect the new rural cooperative medical system ,and ensure sustainable development of the system .Based on the theoretical analysis and investigation , it concludes that the factors affecting sustainable development of the system include scientificity , fairness, effect and guarantee of the system .There are problems in the new rural cooperative medical system in such aspects as financing ,compensation , voluntary participation ,medical funds and supervision of medical institutions .To ensure the sustainable development of the system ,the road of rule of law should be taken , which means to replace the governance of policy with the governance of law .In the regulations of new rural cooperative medical system , the supervision of medical institutions,the medical insurance of migrant workers , the connection with medical assistance system and other medical insurance system should be appropriately handled .
