| 摘 要： | 自清末修律以来,关于法官惩戒的思考与立法实践一直是引人注目的问题.南京国民政府模范中西,斟酌损益,制定了一系列的惩戒规范,构建了独特的法官惩戒制度.根据《公务员惩戒法》,法官惩戒的启动权属于监察院,审议权属于司法院内设的中央公务员惩戒委员会,两者皆有严密而公正的程序,体现了正当程序的基本原理.我国当前尚无专门的法官惩戒法,反思这些历史资源,可以为我国未来的制度设计提供有益的养分.

| Abstract: | Since the Amendments to the Law in late Qing Dynasty ,the Judge disciplinary issues has always been agreat concern. During the rule of the Nanjing government, the legislature formulated a series of disciplinary norms.According to the Discipline of Public Law, the power of starting the procedure belonged to the Control Yuan, andjurisdiction belonged to the Central Government Civil Servant Disciplinary Committee, each of which had fairprocedures. Considering lack of a Judge Disciplinary Law in China, and reflecting on these can provide us a reference. |
