| 摘 要： | 科学地规定罚金刑在刑罚体系中的地位具有十分重要的意义,将罚金刑上升为主刑,但可以并科适用的方案是切实可行的,既使罚金刑主刑地位十分明确,而且毫不影响罚金刑对于自由刑补充功能的发挥,还有外国立法可供借鉴,不失为一个最佳选择。

| Abstract: | It＇ s significant to stipulate scientifically the position of fine punishment in the system of punishment. The schemes of raising fine punishment to principal punishment and being applicated combinedly are feasible, which will be helpful to clarify the position of fine punishment, meanwhile it will bring negative influenee to the supplementary function that fine punishment has to be the free punishment. Foreign legislation also can be used for reference . So it will be the best choice in some degree. |
