| 摘 要： | 我国城市化发展决不能以牺牲农村和农民的利益为代价,必须合理地确定城镇化的发展规模.大量农用地在城市化过程中被转变为非农建设用地,农民失去土地就等于失去了最根本的生存基础.现行的征地制度和保护农民利益的法律仍滞后于经济发展的现实.必须依法加强土地利用总体规划、城市总体规划、村庄和集镇规划实施管理,严格执行土地管理法律法规的规定,建立和完善耕地保护和土地管理的责任制度,完善对失地农民的征地补偿和安置制度,运用物权法来保护失地农民的土地权益.

| Abstract: | The urbanization of China must not sacrifice the benefits of rural regions and peasants. We should fix on the developing pattern of urbanization with reason. A lot of farm land has been changed to construction land in the urbanization process. Peasants losing land equals to losing the essential living element. The current land levying system and laws of protecting peasants' benefits have still lagged the realism of economic development. We must legally enhance the main plan of utilizing land, cities, villages and market towns; strictly execute laws and legal rules on land regulation; build and perfect the obligation system of protection plow land and land regulation; perfect levying land remedy and aftercare system of peasants having lost land; and use the Real Right Law to protect land rights of peasants having lost land. |
