| 摘 要： | 现代法治提出了对司法判决的确定性和正确性的双重要求,＂确定性＂和＂正确性＂这两个对立的概念统一于哈贝马斯所提出的＂有效性＂概念中,内化为＂事实有效性＂和＂规范有效性＂两个维度。平衡艺术是＂事实有效性＂和＂规范有效性＂两个维度的平衡,＂事实有效性＂具有优先性,＂规范有效性＂具有统摄性。说理艺术强化了法律的正当性,体现了公民和法律的一致性,培育公民遵守法律的自觉性,没有说理就没有现代法治意义上的司法判决。
