| 摘 要： | 被害人承诺作为超法规阻却违法性事由得到广泛认同,但是,对于它的正当化根据存在较大争议.正确地界定被害人承诺的正当化根据,对于司法实践有很大帮助.被害人承诺的正当化根据在于,基于社会相当性的利益衡量理论.在实践中,生命法益绝对不能承诺,身体健康法益以及其它个人法益在符合社会相当性范围内可以有限承诺.
