安徽省文化产业立法研究

文化产业是文化与经济结合而生的新兴事物,被认为是最具有发展潜力的黄金产业。笔者从国家战略部署的需要、文化产业对国民经济的贡献、保护民族文化的需要、政策易变而基本法缺位等方面论述了安徽文化产业立法的必要性,结合安徽文化产业立法不系统不科学、立法滞后、执法多头等现状与不足,提出制定文化产业基本法、完善文化产业地方性法规体系、加快政策法律化进程,提供健全的法制环境和构建执法机构等建议,保障安徽文化产业快速健康发展。

On the Legislation of the Cultural Industry in Anhui Province

Culture industry is a new thing of combination of culture and economy, is considered to be the most potential industry. The necessity of cultural industry legislation in Anhui Province is discussed from aspects of the national strategic needs, cultural industry contribution to the national economy, the protection of national culture, policy and law to variable lack. Combined with present condition such as：culture industry legislation is not sys- tematic and scientific legislation, law enforcement, multiple status and deficiencies, the develop cultural industry, the basic law of cultural industry, local laws and regulations system, speeding up the process of legal policy, provi- ding the perfect legal system environment and the construction of law enforcement agencies and so on are pro- posed, so as to guarantee the rapid and healthy development of the cultural industry in Anhui Province.
