贸易壁垒总体上分为关税措施和非关税措施.在关税措施受到世界贸易组织严格限制的条件下,发达国家则转向使用富有弹性的非关税措施,特别是知识产权措施,制造贸易障碍,为自己谋取不当利益.这引起了大多数发展中国家的反对和世界贸易组织的高度关注.中国作为最大的发展中国家也深受贸易壁垒之害.知识产权壁垒已经成为我国贸易发展的主要障碍之一.发达国家知识产权壁垒有着深刻的战略背景,需要我们从战略上加以应对.构建和实施我国的知识产权战略体系既是当务之急,也是一项长期艰巨的任务.

Intellectual Property Rights Barrier and Countermeasures in International Trade

The trade barriers are divided tariff and non-tariff barriers.When tariff barriers are strictly monitored by WTO,the developed countries turn to the more flexible non-tariff measures,especially intellectual property rights(IPR),to create trade barriers and make unfair profits.Such a practice is strongly concerned by most developing countries as well as WTO.As the biggest developing country,China has fallen victim to trade barriers,and one of the chief barrier faced by China is the intellectual property rights barrier.Developed countries create intellectual property rights barrier in line with their strategy,so China must take corresponding strategic measures.It is an urgent task as well as a long-term mission for China to formulate and apply its intellectual property rights strategy.
