| 摘 要： | 《中华人民共和国民事诉讼法修正案(草案)》对民事再审程序进行了修改,但仍有一些内容值得商榷。应以民事诉讼的基本原理为指导,结合司法实践中出现的问题,从再审事由、申请再审的期限、审查方式以及再审案件的审理等方面进一步完善我国民事再审程序。

| Abstract: | The Revised Draft Edition of the Law of Civil Lawsuits of People's Republic of China made modifications of the re-trial procedures of civil cases,but there are still some issues needing further deliberations.This paper suggests that the civil re-trial procedures be improved through re-trial reasons,duration of re-trail appeal,check methods,and trial of the re-trial cases on the basic principles of civil lawsuits and in consideration of the problems of judicial practices. |
