| 摘 要： | 证人证言真实性的保障制度,对于纠纷的解决、公正价值的实现具有十分重要的意义,而我国民事诉讼法对此规定尚存空白,立法上的缺失导致实践中虚假证言的泛滥。为此,我国应建立证人证言真实性的保障制度,即确立诚信原则,建立宣誓制度,引入、改造交叉询问制度等。

| Abstract: | The guarantee system of genuineness of testimony has its unique value on settlement of dispute and implementation of justice.There is no relative rule in the civil procedural law that leads to existence and flooding of false testimony.Therefore,The guarantee system of genuineness of testimony should be established,that is to say,effective methods,which range from establishing both good faith principle and oath-taking to introducing and improving cross-examination,should be taken. |
