论规划效力对政府责任的法律控制

十一五规划首次提出约束性指标对政府责任的法律效力命题，为规划法治化的研究打开了一个切口。规划的法律效力与法律的法律效力存在差异，并且在正当性和可行性上不乏需要论证的疑问。在规划中，约束性指标与预期性指标的法律效力差别，是法律效力的有无还是法律效力的强弱，也值得描述和论证。实现约束性指标对政府责任的法律效力，需要将规划问题转化为法律问题，其关键是在就政府责任的重构，全国性规划与地方性规划、国家预算、产业政策、经济杠杆等的关系作出合理的制度设计。

On the Legal Control of Plan Validity for the Government Responsibility

The Eleventh Five-Year Plan about the thesis of legal validity which is for the first time proposed for the bounded target to the government responsibility has opened the sluices for the legalization of Plan.The validity of Plan and the validity of law have differences,and both for justification and feasibility need to be proved.In the plan,the bounded target and the anticipated target have the difference of legal validity,and whether there is the legal validity or the strong and weak of validity is also worth describing and arguing.Realization of the legal validity of the bounded target to the government responsibility needs to transform the question of Plan to the question of law,which key lies in the design of system,such as the reconstruction of government responsibility,the nationwide plan and the local plan,the state budget,the industrial policy,the economical lever.
