| 摘 要： | 在海上保险中，常常会出现海上保险代位求偿权与被保险人赔偿请求权的冲突，为此，论题分析了两大法系对此问题的看法，指出其中的不同，并从法理上分析了解决此问题应该持有的态度，最后从我国立法的角度入手，分析了其中存在的问题，提出了相关的立法建议。

| Abstract: | In the practice of marine insurance, marine insurance subrogation often conflicts with insurants＇ claims for damages. To solve the prcblem, this essay analyses the theory, of and the differences between British law and Continental law, then points out the proper attitude towards it from the view of philosophy of law. Finally the essay brings forward some legislative suggestions on the base of discussion on the legislation of China and existing problems of it. |
