刑事诉讼中强制采样的困境与出路

强制采样作为一种特殊的刑事侦查手段,有其存在理论与实践价值。但是与此同时,强制采样的存在也会带来一系列的风险。《刑事诉讼法修正案(草案)》的一大亮点是将"尊重和保障人权"明确写入总则第二条,那么如何让强制采样在发挥其最大价值的同时保障人权规避风险,是当前实务界亟待解决的问题。文章拟就这些方面的问题进行简单的论述以期能够寻求强制采样合理运用的途径。

On Predicament and Countermeasure of Compulsive Sampling in Criminal Proceedings

Compulsive sampling,as a special kind of criminal investigation measure,has its theoretic and practical value.But it can also bring lots of troubles.One of the highlights of the "Amendment to the Code of Criminal Procedure(Draft)" explicitly writes the "respecting and safeguarding human rights" into the General Provisions,Article II,Then how to make compulsive sampling protect the human rights and avoid risks,at the same time can maximize use its value is the problem need to be solved in current practice.This paper is mainly about these questions,and also wants to seek the reasonable countermeasures of compulsive sampling.
