| 摘 要： | 生育权由自然权利向法律权利转化,是由社会基本条件决定的,一方面生育利益的外部冲突是促成转化的外因,另一方面生育利益的内部冲突是促成转化的內因。我国生育立法虽然确认生育是一种权利,但在权利保护方面,仍然存在不足,亟待完善。

| Abstract: | The shift of right of bearing from natural right to legal right depends on the basic social conditions.The external conflict of bearing benefit is the external cause of the shift.The internal conflict of bearing benefit is the internal cause of the shift.The legislation on bearing in china has confirmed the right of bearing,but still exists some defects which require perfection in right protection. |
