| 摘 要： | 违宪审查机关在判断立法是否违反平等保护的宪法原则时必须根据合理的基准。美国法院适用的是三重基准,法院主要审查立法的目的、措施以及它们之间的关联性。三重基准的适用不仅可以更有效地保障公民权利,而且有利于巩固违宪审查机关的宪法地位,对中国的违宪审查制度的建设也具有启示意义。

| Abstract: | Constitutionality review organs should adopt a reasonable stand in judging whether a law concerning equal protection is constitutional or not.In USA,three-stand is adopted by the courts.According to the stand,the courts shall review the aim and measures their relations.The adoption of three-stand is beneficial to protecting individual rights more effectively and consolidating the role of court in constitutional frameworks.Meanwhile,the theory of three-stand is a reference for constructing the system of constitutionality review in China. |
