| 摘 要： | :危险犯是指以行为人实施的危害行为足以造成法定危险状态作为既遂标志的犯罪。危险犯的特征是 :以出现法定的危险状态作为成立犯罪既遂的标志 ;法定的危险状态必须是由危害行为造成的 ;危险状态都有相应的实害结果。具体危险犯是指以行为人实施的危害行为造成法定的具体危险结果作为犯罪构成必要条件的犯罪。抽象危险犯是指以行为人实施的危害行为所造成的抽象危险结果作为犯罪构成的必要条件的犯罪。危险结果的认定应为一般人标准与科学标准相结合

| Abstract: | Potential damage offense is a crime that its consummation is due to disfeasor's dangerous act causing enough legal danger state. Its characteristics are:Firstly, its consummation is due to legal danger consequence state coming out; Seconly, its legal danger state must be caused by dangerous acts; Thirtly, its danger consequense has corresponding actual damage consequense. Concrete potential damage offense is a crime that regards dangerous act causing legal concrete danger consequence as indispensable constitutive elements. Abstract potential damage offense is a cime that regards dangerous act causing legal abstract danger consequence as indispensable constitutive elements. Determining dangerous consequence must combine general people's standard and scientific standard. |
