| 摘 要： | 刑法修正案（八）规定了依法实行社区矫正,标志着社区矫正工作进入到一个新的发展阶段。社区矫正作为非监禁刑罚的执行方式,应当主要由检察机关进行法律监督。本文主要探讨了在新的背景下社区矫正检察监督存在的问题,明晰检察机关在监督中的角色定位,检察监督如何完善具体作法,探讨当前情况下对此提出针对性的完善建议。

| Abstract: | Criminal Law Amendment(8) provides for the implementation of community corrections law,marking the Community Corrections entered into a new stage of development.Community corrections as a non-custodial sentence of execution should be mainly carried out by the prosecution of legal supervision.This article discusses the context of the new inspection and supervision of community corrections problems,clears the prosecution’s role in the supervision,and shows the inspection and supervision of improving specific practices of the current circumstances,and makes this targeted improvement recommendations. |
