韦伯与哈贝马斯法治观之元理论比较

摘    要:从合理性的视角给法治一种元理论的解释,韦伯与哈贝马斯的研究路径各有千秋。韦伯根据波普尔对世 界的三种区分,即客观世界、主观世界和社会世界,将其目的行为对准客观世界,并以目的行为为取向,型构其形式 理性主义。韦伯的形式法治直接导源于他的形式合理性。哈贝马斯在世界三分的基础上,引入世界的第四个界 面,即生活世界。以此为切入点,哈贝马斯以沟通为行为取向,建构其交往理性主义。程序主义的法律范式正是通 过对交往理性的建构才得以形成。

Abstract:From the angle of view of the rationality the explanation to the rule of law is given, whose path to research of Weber and Habermas is different. The behavior of Weber is based on the three worlds, that is to say, objective world, subjective world and social world. The behavior of Weber aims at objective world, tropism of whose is to aim. The rationality of Weber is objective. Formal law of Weber's comes from formal rationality directly. On the three worlds, Habermas introduces the fourth interface of the world, which is living world. Habermas constructs intercourse rationality on the basis of intercourse behavior, tropism of whose is to communicate. Procedure creed of law comes from intercourse rationality like a shadow following its body.
