| 摘 要： | 合同的相对性是整个合同法制度和理论的基础之一。本文探讨了合同相对性原则的内涵及例外规定,并就我国《合同法》中体现合同相对性原则的制度以及在此基础上的例外规定作了分析和评价,并对完善《合同法》在这方面的规定提出了建议,期望《合同法》更富有人情味。

| Abstract: | The relativity of the contracts is one of the foundations of the system and theory of the Contract Law. This paper has analyzed the essence and exceptions to this relativity principle, and those provisions which reflect and develop the principle in the Contract Law of China, and further given evaluations and suggestions, which are expected to be of help to modification and perfection of the Contract Law. |
