传统主权理论面临的挑战和思考

主权理论自布丹在16世纪提出以来,几经变迁,人民主权从此成为不可超越的主权理念。但是传统主权理论在实践中面临着多方面的挑战。在国际法和自愿基础上的主权让渡不违背主权原则;而现在谈民族国家消亡为时尚早,主权并不是一个“过时”的概念,只要国家的政治、经济、社会、文化和军事的功能存在,主权国家就不会消亡;理论上的争执和相对主权观并不能成为干涉他国主权的理由;主权是解决国家利益问题的核心,是随国家利益的变化而变化的。

The Facing Challenge and Thinking of Traditional Sovereignty Theory

Sovereignty Theory was put forword by Budan in 16th century.From then,the people sovereign right has become a block of wood for exceeding after changes.But,the traditional sovereignty theory is con-fronted with challenges in practice.The sovereign transfer based on international law and volunteering is not going against sovereignty principle;Sovereignty is really not a "obsolete" concept now,and it is the core factor to resolve national interest.
