| 摘 要： | 受教育权具有绝对权利属性。国家要积极保障受教育权的实现,积极促进受教育权的实现,同时国家教育的积极作为应以不侵犯受教育权为限,对侵犯受教育权的各类现象应当引起足够重视。要保障义务教育主体的受教育权应坚持平等原则、补偿原则、公开原则并遵守国际法义务。

| Abstract: | Right to education has the attribute of absolute power.The state should act positively in order to ensure the implementation of right to education.At the same time,the negative duties from the state should not be neglected.Make sure that right to education of the main body of compulsory education must persevere by equality principle,indemnity principle and opening principle;otherwise it also should comply with the obligation of International Law. |
