| 法律文化何以从混乱走向融合——以《白鹿原》中的一个事件为例 |

| 摘 要： | 对《白鹿原》中的一个事件的分析表明,法律文化的多元可能导致法律意识、心理层面和法律行为、法律实施方面的混乱和冲突;国家与地区之间的发展不平衡,以及利益、需求的多元性,是引起矛盾的深层原因。法律文化从混乱走向融合的途径,是以"理解、对话"去取代"消灭、征服"的认识模式,以现实的、多元化的眼光和慎思,去处理法律多元情形下的种种矛盾。但这些矛盾的解决,最终还取决于需求和利益结构的变化,及其背后包括生活情景、经济条件在内的社会条件的变迁。

| Abstract: | This essay describes the problems that were produced after the meeting of the multifactors in legal culture,such as :the multiplication of the legal culture leads to some disorders and conflicts,both in the psychological level of legal consciousness and the implementation of the law.and points out that economy,the imbalance of social development,interests and their pluralism bear some relation to and exert some influence on legal reforms,legal transplant.So we propose the must-taken way and the expedient of legal culture trending from disorder into mixture. |
