| 摘 要： | 在民事审判中,法官适用裁判性规则需运用自由裁量权。为了实现司法公正,自由裁量权的行使应遵循客观的理性人标准。理性人是法官拟制的中立的、独立的判断者。理性人的构建以常人能力为基础,以具体案件的行为场景为背景。理性人标准是对自由裁量权的规制,能有效地预防自由裁量权的滥用。

| Abstract: | In civil adjudication,when dealing with flexible regulations judges must exercise the discretion.In order to realize the justice of adjudication,exercising discretion must abide by objective reasonable person standard.Judges fabricate the reasonable person as a neutral,independent observer.The creation of reasonable person is based on the capacity of ordinary person and is the background of concrete cases.The reasonable person standard can prevent discretion from abusing. |
