论风险社会语境下的环境法预防原则

风险社会中风险是人们不能回避的问题,包括环境风险,应对环境风险环境法应有所调整。预防为主原则是中国环境法的基本原则,风险社会背景中该原则不论在立法上还是在实践中都面临着困境,因此有必要对该原则进行重构、拓展。在思想理念上将预防原则贯穿于立法、司法、执法和守法的全过程中,从治理污染向预防污染转变,从治理风险向预防风险转变;在表述上将预防为主原则向预防原则转变;在内容上增加以弱势形式规定的风险防范原则。

Precautionary Principle of Environmental Law in the Context of Risk Society
