国务院决定行政许可设定权:问题与规制

《行政许可法》第14条第2款所规定的国务院决定的行政许可设定权是特殊状态下的临时性权力,国务院依据这一职权所设定的行政许可应及时转化为法律、行政法规设定的行政许可.国务院《行政许可决定》设定的500项行政许可存在数量庞大、个别主体不规范以及没有及时转化为法律、行政法规所设定的常规性行政许可等问题.为保证《行政许可法》第14条第2款的实施,应由国务院制定相关规范,从明确行政许可设定的“必要性”标准、规定行政许可实施的“临时性”期限、控制行政许可设定的数量以及完善对行政许可的评价机制等方面,对国务院决定行政许可权设定权进行必要的规制.

The Power of Setting Administrative Permissions by the State Council's Determination: Problem and Regulation

The power of setting administrative permissions by the State Council’s determination is a temporary power defined in Article 14.2 of the Administrative permission law.These permissions set by the State Council’s determination should be transferred into those set by laws or administrative statues.The determination of the administrative permissions by the States Council has set about 500 permissions with the problems such as huge numbers,irregular units,delay of transferring and so on.For the purpose of carrying out Article 14.2 of the Administrative permission law,the State Council should set the regulations to clear the standard of "necessary",the limitation of temporary,the control of permission number and the system of judging administrative permissions.In a word,we need regulations of the power of setting administrative permissions by the State Council’s determination.
