| 摘 要： | 在研究多位学者论著及国外立法的基础上,试图对隐私与隐私权作一个较全面的分析。提出隐私实质是私人的信息、空间或生活等自我披露控制的自主,而隐私权应当是自然人的私人生活安宁和私人信息秘密不被他人非法侵扰、知悉、收集、利用和公开的一种人格权和防御性权利。

| Abstract: | This thesis attempted to make a comprehensive analysis to privacy by studying the professional outcomes of many authors and foreign legislations.It maintains that privacy is essentially self-control on private information or space or relationship and so on and suggests that the right of privacy should be of a kind of personality that protects oneself from invasion,being investigated and disclosed in private life and private information,which is also a defensive right. |
