受害人近亲属精神损害赔偿研究

我国立法对受害人近亲属精神损害的规定比较笼统,在司法实践中尚存有很多问题需要解决。在借鉴国外先进立法和司法实践的基础上,对可请求精神损害赔偿的受害人近亲属的主体范围、近亲属的精神损害的界定以及赔偿数额的算定等主要问题进行深入研究,并提出一些粗浅的建议,以期对完善具有中国特色的民事侵权精神损害赔偿制度有所裨益。

Study on Moral Damage for Near Relatives

The legislation on moral damage to near relatives is so general in our country.Many problems generated in judicatory practice need to be solved in this field.On the basis of some legislations and judicial practice in foreign countries,the authors make a tentative study on the dimension of subjects,the definition of moral damage,the compensable amount of moral damage to near relatives and so on.At the same time,the authors give some suggestions in hope of perfecting the system of mental distress in modern tort law in China.
