| 摘 要： | 行政垄断是我国赶超型战略及经济体制转轨的副产品,有体制的、政治的、经济的、法律的、管理的等诸方面的原因,涉及国家、公民与社会之间的关系,因此乃是宪政问题.其实质是权力滥用、以权谋利,是违背全面、协调、可持续的科学发展观的要求的.鉴于行政垄断巨大的破坏性,威胁社会公平,耗散政治租金,损害市场秩序,应该通过多方面的制度变革予以破解.经济改革和反行政垄断本质上是宪政转轨的组成部分.
