| 摘 要： | 婚约作为婚姻关系成立的前置程序,界定其法律属性应以正确认识婚姻的法律属性为前提。通过法理学与民法学理论分析,可以得出婚姻契约性质的结论。而婚约作为婚姻缔结过程中相对独立的阶段,其性质应属于婚姻契约的预约合同,故认为违反婚约的法律责任应纳入违约责任的范畴。

| Abstract: | Engagement is the preceding procedure of the marriage relationship,and the premise of the legal attribute of engagement is the legal attribute of the marriage.Through theoretical analysis of the jurisprudence and civil law,we come to a conclusion that marriage is contract.As the relatively independent stage of marriage concluding,the legal attribute of engagement is pre-contract of marriage.So we should bring the legal liability of engagement violation into the category of liability for breach of contracts. |
