| 摘 要： | 本文从《刑法》第140条的“销售金额”展开论述，讨论了其出现的原因，并结合最高人民法院的司法解释中提出的“货值金额”以及对本罪未遂形态的认定．阐释了由于销售金额而引发的一系列理论矛盾，并结合选择性罪名的一些基本问题，提出了重构生产、销售伪劣产品罪的观点。

| Abstract: | Starting from the term "total sales" in clause 140 in criminal law,and referring to the Supreme Court's opinions on the definition of "total sales" and attempted crime,this article expounds the reason why it emerged,and clarifies a series of theoretical conflicts arising from "total sales".Based on the basic theory of optional accusation,this article brings forward an opinion on restructuring the accusation for producing and selling fake and inferior goods. |
