论陪审制度的改革与完善

我国人民陪审制度的立法历经变迁,由于现行宪法删除了对陪审制度的规定,加之陪审员制度存在着不足,导致人民陪审制度被淡化。本文从当前我国陪审制度存在的问题以及为充分发挥陪审制度的固有价值、实现民主政治的功能等方面论述了对陪审制度加以改革和完善的必要性。主张从完善陪审员的任职资格条件,对新类型案件、专业性强的案件实行专家陪审制度,建立陪审员的选择与回避制度和建立陪审员更换与庭审更新制度等八个方面构建和完善陪审制度。

About Reformation and Perfection of the Jury System

The legislation of the people's jury system in our country has changed many times. Since the constitution in force deletes the stipulation of jury system, concerning the shortcomings in juryman system, this system is weakened. The article discusses the necessity of reforming and perfecting the jury system from the viewpoints of existing problem, innate value of jury system, and function of democracy. The article holds that we must construct and consummate the jury system from eight aspects, for example, qualification terms of a juryman, expert jury system in new and special cases, selection and challenge of juryman, and renewal of court hearing system.
