| 摘 要： | 为了克服经济自由的弊端,经济权利应运而生。经济权利是指以实现经济公平为目的,着力克服经济自由的弊端,是国家积极干预经济的结果,是与经济自由完全不同的、人们能够比较公平地享受经济发展成果的一种独立的权利。其包括可诉型经济权利和目标性经济权利。对于这两种经济权利,宪法应采取不同的保障模式。

| Abstract: | The necessity of overcoming the disadvantages of free economy gives rise to economic rights aimed at a fair economy.Totally different from economic freedom and brought about by state intervention,economic rights enable citizens to enjoy the fruits of economic development.Economic rights fall into actionable economic right and target economic right.Accordingly,different constitutional protections should be provided. |
