论公共设施致害的国家赔偿问题

本文通过对公共设施致害的整体分析，明确在法制社会里国家对公共设施的法律责任。建议通过完善《国家赔偿法》，把公共设施侵权损害纳入国家赔偿责任范围，从而督促国家向公众提供更安全合理的公共设施及服务，也使公民权利受损救济途径更趋向法律多元化。

On State Compensations for the Damage of Public Facilities

Through an overall analysis of the damage of public facilities this paper identifies the state's legal responsibilities for public facilities in a society ruled by law. It is suggested that the Law of State Compensations be perfected in order to include the tort and damage of public facilities in state compensations, urge the state to provide the public with better and more reasonable public facilities and services, and diversify the legal ways of relief for the violations of the citizens' rights.
