| 摘 要： | 行政赔偿程序是对赔偿义务机关行使公权力的有效约束,是对赔偿申请人合法权益的一种有效保障,符合科学发展观以人为本的思想,是构建和谐社会,有效化解社会矛盾的制度保障。通过对法律程序、行政赔偿程序等基本概念的分析,并借鉴各国行政赔偿程序立法的先进经验,提出了进一步完善我国行政赔偿程序的立法建议。
